Effective Date: 13 August 2025
These Terms & Conditions govern all equipment hire agreements with Air Ventilation & Testing UK Ltd (“AVT UK”, “we”, “us”, “our”).
By placing an order with us, you (“the Hirer”) agree to these Terms in full.
1. Definitions
Equipment – Any items supplied for hire by AVT UK, including accessories, manuals, and protective cases.
Hire Period – The agreed hire duration starting from delivery or collection until the Equipment is returned and inspected.
Security Deposit – A refundable payment taken in advance to cover potential loss, damage, cleaning, recalibration, or late return.
Replacement Value – The full retail cost of new Equipment of the same make and model.
2. Ownership
All Equipment remains the sole property of AVT UK at all times.
The Hirer has no right, title, or interest in the Equipment other than as a temporary bailee.
The Hirer must not sell, sub-hire, pledge, or otherwise dispose of the Equipment.
3. Hire Charges, Deposit & Payment
All hire charges and delivery/collection fees must be paid in full before dispatch, unless otherwise agreed in writing.
A £1,000 Security Deposit is required for each hire. This will be refunded within 7 working days of return, subject to inspection.
AVT UK may retain part or all of the deposit to cover:
- Damage, loss, or theft
- Missing accessories or manuals
- Cleaning or recalibration costs
Late return charges
If costs exceed the deposit, the Hirer must pay the balance within 7 days.
4. Delivery, Risk & Return
Delivery and collection charges will be agreed at booking.
Risk of loss, damage, or theft passes to the Hirer upon delivery and remains until return and inspection.
The Hirer must:
Inspect the Equipment upon delivery and notify AVT UK immediately of any defects
Ensure the Equipment is available for collection at the agreed date and time
Returns must be securely packaged. Damage caused by inadequate packaging during return transit will be charged to the Hirer.
5. Hirer’s Responsibilities
The Hirer must:
- Use the Equipment only for its intended purpose and in accordance with the operating instructions.
- Ensure all operators are competent and trained in safe use.
- Not alter, modify, or repair the Equipment.
- Notify AVT UK immediately in the event of a fault, loss, theft, or damage.
6. Damage, Loss & Theft
The Hirer is responsible for the full Replacement Value of any lost, stolen, or irreparably damaged Equipment.
The Hirer remains liable even if the loss or damage is caused by third parties, adverse weather, accident, or other circumstances beyond their control.
Any theft or criminal damage must be reported to the police and a crime reference number provided to AVT UK.
AVT UK may charge daily hire rates until replacement payment is received.
7. Calibration & Condition
Equipment is supplied in working order, clean, and calibrated to industry standards.
The Hirer must return Equipment in the same condition.
Cleaning and recalibration fees will apply if the Equipment is returned dirty, contaminated, or damaged.
8. Late Returns
Late returns are charged at the daily hire rate until the Equipment is received back.
If Equipment is not returned within 7 days of the agreed date, AVT UK reserves the right to treat the hire as a sale and invoice the full Replacement Value.
9. Insurance
The Hirer must insure the Equipment for its full Replacement Value against loss, theft, and damage during the Hire Period.
Proof of insurance may be requested before dispatch.
10. Cancellation
Cancellations more than 48 hours before dispatch: Full refund (minus delivery charges).
Cancellations within 48 hours of dispatch: Up to 50% of the hire charge may be retained.
No refund once Equipment has been dispatched.
11. Liability, Indemnity & Disclaimer
AVT UK is not liable for:
Loss of profit, revenue, or business
Consequential or indirect losses
Delays due to events beyond our control
Any incorrect or invalid results obtained due to improper use, lack of training, or failure to follow operating instructions
Any fines, penalties, or losses arising from failed building compliance tests carried out using the Equipment
All responsibility for the correct operation, measurement accuracy, and compliance with building regulations lies solely with the Hirer.
The Hirer shall indemnify AVT UK against all claims, damages, expenses, or legal costs arising from:
Misuse or mishandling of the Equipment
Injury or property damage resulting from its use
Reliance on results produced by the Equipment without independent verification
12. Force Majeure
AVT UK will not be liable for delays or failure to perform if caused by events beyond our reasonable control, including but not limited to strikes, accidents, transport delays, fire, flood, or equipment supplier failure.
13. Recovery of Costs
The Hirer shall be liable for all costs incurred by AVT UK in recovering unpaid charges, replacement costs, or damages, including legal fees and debt collection costs.
14. Governing Law
These Terms are governed by the laws of England and Wales.
All disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
